This contest, entitled “Win ​​a Gift Card”, is an action carried out by BRIGHT BRANDS SPORTSGOODS, SA, with registered office at Via do Castelo do Queijo, No. 395 Edifício Transparente Lojas 22 e 23, 4100-429 Porto, registered at the Lisbon Commercial Registry under the unique registration and corporate tax number PT 514 485 680, with a share capital of 5,208,780.00 Euros, hereinafter referred to as the "Promoting Entity" or "Deeply".

1. Who is it intended for?

1. This promotion is intended for all Deeply customers who are individuals, of legal age, and residing in Portugal, and who are not yet subscribers to the Deeply newsletter (hereinafter "participants").

2. The following will not be admitted to this action: direct family members of employees, nor the employees themselves of any company of the Promoting Entity, including agents, sponsors, employees of other companies that are in a group relationship with the company, and all those who are objectively in a position to illegitimately benefit from privileged and non-public information related to the action, nor all those who are objectively in a position to illegitimately alter its course, including the family members of any of these persons.

3. Participation is not permitted for participants using devices that can block lines or grant them any technical advantage over others, and Deeply reserves the right to take legal action against them.

4. Any participant who acts in bad faith and participates in the promotion using false information, thus rigging the promotion, will be automatically disqualified if identified.

5. Any and all illegal actions taken to gain a competitive advantage during this promotion will be considered fraudulent, and Deeply reserves the right to disqualify any participant whose actions fall under this article.

6. Participants who win prizes in the competitions

7. 7. In order to confirm the identity of the winning participant, they must provide Deeply with a copy of an identification document when requested.

8. Deeply reserves the right to reject any entries that are incomplete, incomprehensible, damaged, or otherwise irregular. It also reserves the right to reject entries that are illegal, indecent, racist, defamatory, or otherwise deemed harmful.

9. Deeply assumes no responsibility for untimely submissions, including, but not limited to, calls or emails not received due to technical interruptions, network failure, blocking and interruption of access to the online server, computer error, or other factors over which Deeply has no direct control.

Second phase of the action.

You can participate in this promotion from 9:00 AM on January 1st, 2023 until 11:59 PM on January 31st, 2023. The prize and the winning participant will be announced by February 10th, 2023.

3. How to participate

1. During the period of the promotion, participants who meet the requirements mentioned in clause 1 and who wish to participate in this promotion must subscribe to the Deeply newsletter, available at https://deeply.com/ , thus facilitating access to their email address and name.

1.1. To formalize your participation, you must go to the website https://deeply.com/ and fill out the participation form, providing your email and name.

2. A monthly prize will be awarded for 3 months. The winning entry will be chosen randomly using an electronic platform, which can be accessed at https://app-sorteos.com/

3. 3. One winning participant and alternate participants will be chosen. The alternate participants will assume the winning participant's position if the first-place participant's participation is deemed fraudulent or otherwise contrary to the terms of these rules, or if it is not possible to contact the winning participant using the information provided for prize delivery. Deeply will make two contact attempts at least 24 hours apart. If the winning participant does not respond within 48 hours of the second contact attempt, the winning participant's status will automatically pass to the first alternate, and the same procedure will be followed for subsequent alternate winners.

4. 4.1 Each participant can only qualify as a winning participant once during this promotion.

4th Prize Description

1. One gift card, valid for six months from the date of delivery, for each winning participant.

Gift card valid for six months, with a total value of 100 euros to spend on purchases at https://deeply.com/ .

Excludes:

Personal expenses, extra consumption, insurance of any kind or form, and anything not specifically identified as in the "includes" section above.

2. The prize in this promotion is personal and non-transferable and cannot be exchanged for any other prize, nor redeemed for cash or bank check, or subject to any alteration or compensation at the winner's request.

5th Award Ceremony

1. The winner's email address will be revealed by the 10th of each month in which the promotion takes place.

2. The winner will be contacted within 2 days of the announcement described in Article 1 of this clause, by Deeply or another entity designated by Deeply, using the email address provided by them in connection with this promotion.

3. If it is impossible to contact the winning participant due to incorrect data or any other reason beyond Deeply's control, their status as winner will pass to the runner-up, as described in more detail in clause 3, article 3.

4. The prize will be delivered via email within a maximum of 4 days from the date the winning participant is contacted, as described in articles 2 and 3 of this clause.

5. The prizes are personal and non-transferable and cannot be replaced by other prizes or exchanged for money; therefore, acceptance of the prize implies the winner's agreement and availability in relation to it.

6. The winning participant acknowledges and accepts that, as this is a donation, the prize awarded to them is not subject to the seller's legal warranty, and therefore Deeply cannot be held responsible for any lack of conformity of the item.

6. Protection of personal data

1. Deeply adopts best practices for security and protection of personal data in compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, as well as applicable national legislation (“Data Protection Legislation”).

2. The Promoting Entity acts as the data controller for the personal data of all participants.

3. The collection and processing of personal data is based on the legitimacy of such processing being necessary to execute and manage the participant's involvement in this promotion (execution of the terms and conditions of participation), compliance with legal obligations to which Deeply is subject, and the fact that the processing is necessary for the purposes of Deeply's legitimate interests in managing the promotion, within the scope of voluntary and free participation, and for the purposes of determining and potentially disclosing the winner's status.

4. If the winning participant consents, their personal data will be processed for the purpose of sending marketing communications.

5. The only personal data collected for registration purposes in this promotion are the participant's email address and name. This data is necessary for participation in the promotion and will be processed and stored electronically.

6. The Data Controller ensures that the processing of personal data will be carried out to the extent necessary for the pursuit of [their objectives]. If consent is collected for the purpose of sending marketing communications via the email provided by the data subject, the email will be kept as long as the participant subscribes to the newsletters. If the participant stops subscribing to the newsletters for 5 consecutive years, Deeply will stop sending them and will delete their contact information from the database.

7. The Controller thus undertakes to guarantee security.

8. The Controller ensures that the data subject has the right to access their personal data at any time and without undue delay, as well as the right to rectification, erasure, portability, restriction of processing, objection to processing and/or the right to withdraw consent at any time, without this act affecting the lawfulness of the processing carried out based on the consent previously given.

To exercise any of the aforementioned rights, the holder of personal data must write to the registered address of the Data Controller(s) or via the following email address: info@deeply.com.

9. Requests will be handled with special care to ensure the effectiveness of the rights of the data subject. Proof of identity may be requested to ensure that personal data is only shared with its owner.

10. Furthermore, the holder of personal data may always file a complaint with the National Data Protection Commission, the national supervisory authority authorized for this purpose.

7. General Provisions

1. The advertising for this initiative will be done through the website https://deeply.com/ and a social media advertising campaign, with the Promoting Entity obliged to clearly state all the conditions relating to it.

2. The rules for the initiative will be available on the Deeply page at https://deeply.com/pages-regulamento .

3. If, during the period of this promotion, any illegal or fraudulent activity occurs, or any factor beyond Deeply's control affects the proper functioning of the promotion, these are considered by the parties, for all legal purposes, as justifiable reasons. In this case, Deeply reserves the right to alter, shorten, delay, extend, or cancel the initiative, without the participant being entitled to any compensation.

4. Deeply reserves the right to extend the end date of the initiative.

5. Participation in this promotion implies full knowledge and acceptance of these terms and conditions by any participant; therefore, Deeply reserves the right to refuse participation to any participant who does not comply with them.

6. The Organizing Entity cannot be held responsible for any incident that occurs after the prize has been awarded to the winning participant.

7. Any fraudulent activity or failure to comply with the rules of the promotion may result in the complete exclusion of any participant from this initiative. The Organizing Entity reserves the right to take legal action against any violations of these regulations, if deemed necessary.

8. 8. For technological or non-technological reasons beyond Deeply's control, arising from force majeure events, the service may be unavailable for short periods of time. Deeply has not assumed responsibility, to the maximum extent legally permitted, for incidents occurring due to such force majeure events.

9. Any unauthorized attempt to invade computerized or communication systems supporting the operation will be considered illegal and reported to the competent authorities for appropriate action.

10. Any doubts, disagreements or situations not foreseen in these regulations will be judged and decided by the Courts of the Lisbon District.

11. If the participant is a consumer, please note that in the event of a dispute, they may resort directly to an Alternative Dispute Resolution Entity for Consumer Disputes, since consumer disputes of low economic value (less than €5,000.00) are subject to mandatory arbitration or mediation when, by express choice of the Users, they are submitted to the assessment of an arbitration tribunal attached to legally authorized consumer dispute arbitration centers.

12. Even if one or more provisions of these Regulations are deemed illegal, invalid, void, or unenforceable, the remaining provisions not affected by the defect in question shall continue in full force and effect.

13. Nothing in these terms restricts the statutory rights that participants will have if they are considered consumers for the purposes of applying certain legislation in force in the Portuguese legal system.

14. This Regulation is governed by the laws in force in Portugal.
